1. Who you are contracting with
These Terms govern your use of Provision Garden Menu (the "Service"), provided by Provision Garden Menu ("we", "us"). By creating an account or using the Service you agree to these Terms.
2. The Service
Provision Garden Menu is a weekly family meal planner that uses what's ready in your garden, filters allergens, and closes nutrition gaps with whole food recommendations.
3. Account & accuracy
You must provide accurate information, keep your credentials confidential, and are responsible for activity under your account. If you sign up on behalf of an organization, you confirm you have authority to bind it. Individuals must be of legal age in their jurisdiction.
4. Acceptable use
You agree not to:
- use the Service for any unlawful purpose;
- commit fraud, send spam, or attempt to deceive other users;
- infringe intellectual property or privacy rights of others;
- interfere with the security or integrity of the Service (malware, probing, scraping, reverse engineering, or circumventing technical limits);
- resell, redistribute, or sublicense the Service.
5. Intellectual property
We retain all rights, title, and interest in the Service, including software, documentation, and branding. We grant you a limited, non-exclusive, non-transferable right to use the Service within your selected plan.
6. User content
You retain ownership of content you submit (e.g. household preferences, garden inventory). You grant us a limited license to host and process this content solely to provide the Service.
7. Payment & subscription terms
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, taxes, cancellations, and refunds are governed by the Paddle Buyer Terms.
Subscriptions renew automatically each month at the price displayed at checkout until cancelled. You can cancel anytime from your account; cancellation takes effect at the end of the current billing period.
8. Service level
We work hard to keep the Service available, but do not guarantee uninterrupted or error-free performance. To the fullest extent permitted by law, we disclaim all implied warranties including merchantability and fitness for a particular purpose.
9. Suspension & termination
We may suspend or terminate access for material breach of these Terms, non-payment, security or fraud risk, or repeated/serious policy violations. On termination, you may export your data within 30 days, after which it may be deleted.
10. Limitation of liability
To the fullest extent permitted by law, our aggregate liability under these Terms is capped at the fees you paid in the 12 months preceding the claim. We are not liable for indirect, consequential, or special damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability for fraud, death, or personal injury where prohibited by law.
11. Indemnity
You agree to indemnify us against claims arising from your content, unlawful use of the Service, or violation of these Terms.
12. Governing law
These Terms are governed by the laws of the seller's jurisdiction. Disputes will be resolved in the courts of that jurisdiction.
13. Changes
We may update these Terms from time to time. Material changes will be communicated by email or in-app notice.
